Curated Dental Care — HIPAA Privacy, Website Privacy & Informed Consent

This page explains how we protect your information, how we may use or share it, your rights, and our consent policies for in-office, mobile, and teledentistry services. It includes our HIPAA Notice of Privacy Practices, our website privacy policy (for non-medical site data), and our informed consent policy.

1) HIPAA Notice of Privacy Practices (NPP)

We are a HIPAA “covered entity.” You have the right to a clear notice of how we use and disclose your Protected Health Information (PHI) and the rights you have over that information.

A. How we may use and disclose your PHI

We may use or disclose PHI without your written authorization for:

  • Treatment — diagnosing, planning, and providing care; consulting or referring to other providers or labs.
     
  • Payment — billing you/your plan, verifying benefits, prior authorizations, claims management.
     
  • Health care operations — quality assessment, training, audits, accreditation, licensing, business management.
     

We may also use/disclose PHI as permitted or required by law, including: public-health reporting; health oversight; judicial/administrative proceedings; law enforcement; to avert a serious threat; workers’ compensation; decedents; organ/tissue donation; and limited research under applicable safeguards. We disclose only the minimum necessary except for treatment.

B. Uses/disclosures requiring your written authorization

We will obtain your written authorization before using or disclosing PHI for marketing not otherwise permitted, the sale of PHI, or most uses of psychotherapy notes. You may revoke an authorization at any time in writing (except to the extent already relied upon).

C. Your HIPAA rights

  • Access & copies of your PHI (paper or electronic).
     
  • Request restrictions on certain uses/disclosures (we’re not required to agree, except for out-of-pocket payment restrictions).
     
  • Confidential communications (alternate address/phone).
     
  • Amend your record.
     
  • Accounting of disclosures (non-routine).
     
  • Paper/electronic copy of this Notice.
     
  • Breach notification of unsecured PHI.
     

D. Our duties

We must maintain the privacy of PHI, provide this Notice, abide by it, and notify you of breaches of unsecured PHI in accordance with HIPAA. If we change our privacy practices, we will update this Notice and post the new version on our website and at the point of care.

E. California supplement (CMIA breach-notice timing)

For California patients, if there is an unauthorized access, use, or disclosure of medical information, we will notify you in writing without unreasonable delay and no later than 15 business days after detection, consistent with California law.

F. Complaints and questions

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health & Human Services, Office for Civil Rights (OCR). Filing a complaint will not affect your care. Deadlines and online filing are available on the HHS OCR website.

2) Website Privacy (non-HIPAA data)

Some information collected on our website (e.g., cookies, IP addresses, general analytics) may not be PHI and thus not governed by HIPAA. We still safeguard it.

  • What we collect: device/usage data (analytics), pages viewed, approximate location, referral source; information you submit (name, email, phone, messages, appointment requests).
     
  • How we use it: operate and improve the site; respond to inquiries; schedule; security/fraud prevention; comply with law.
     
  • Sharing: with service providers (hosting, analytics, EHR/CRM, email/SMS vendors) under confidentiality; if legally required; or during a business transfer.
     
  • Cookies/Do Not Track: your browser may offer controls; we may use cookies and similar tech to function and for analytics.
     
  • Children: the site is not directed to children under 13; clinical care for minors is handled through HIPAA processes with parent/guardian involvement.
     

Note: PHI collected and used for treatment/payment/operations is covered by HIPAA and California’s CMIA. Some consumer privacy laws (like CCPA) do not apply to PHI but may apply to non-PHI site data.

3) Informed Consent Policy (in-office, mobile & teledentistry)

We follow CDA/ADA guidance: informed consent is a conversation plus documentation covering the nature of the procedure, benefits, material risks, and reasonable alternatives—including no treatment. Consent must be voluntary and can be withdrawn at any time.

A. General consent to evaluation and routine care

By scheduling and presenting for care (in office, mobile visit, or virtual), you consent to evaluation and routine procedures needed to diagnose and plan treatment (e.g., exam, radiographs, photos, prophylaxis).

B. Procedure-specific informed consent

Before non-routine or invasive procedures (e.g., extractions, periodontal therapy, crowns/bridges, implants, endodontics, oral surgery, sedation), we will review:

  • Diagnosis & proposed treatment
     
  • Material risks/complications (e.g., pain, infection, swelling, bleeding, nerve or tooth injury, restoration failure, sensitivity, TMJ symptoms, anesthesia/sedation risks, allergic/adverse drug reactions)
     
  • Benefits & expected outcomes (no guarantees)
     
  • Reasonable alternatives and their risks/benefits — including no treatment
     
  • Post-op expectations and home-care instructions
    You may ask questions and accept/decline; we document your consent (written/electronic) in your record.
     

C. Medications, anesthesia & allergies

Please disclose all medications, supplements, allergies, and medical conditions. Some treatments require pre-medication, fasting, or escorts; we provide written instructions.

D. Imaging, lab services & devices

You consent to radiographs, intraoral scans/photography, impressions, and lab fabrication as needed. We may share the minimum necessary PHI with dental labs and imaging facilities to complete your care.

E. Teledentistry consent

When care is delivered via telehealth, we will obtain your consent as required by California law. Telehealth has limitations (no tactile exam) and may require in-person follow-up. You may withdraw consent and request in-person care when clinically appropriate.

F. Minors & representatives

For minors or adults lacking capacity, consent must come from a parent, legal guardian, or authorized representative. We may request documentation of authority.

G. Photography & testimonials

Clinical photos may be used for diagnosis, planning, and documentation. Any use for marketing/education requires a separate written authorization, which you may revoke at any time.

H. Financial consent

You are responsible for charges not paid by your plan. Insurance benefits are between you and your plan; estimates are not guarantees of payment.

4) Electronic Communications & Data Security

  • Email/SMS: By providing an email or mobile number, you consent to receiving appointment reminders and care-related messages. Email/SMS may carry security risks; you can opt out.
     
  • Safeguards: We use administrative, technical, and physical safeguards to protect PHI and site data (access controls, encryption where appropriate, staff training).
     
  • Retention: Records are retained per California and federal law and our internal policy.
